Organizaciones de la sociedad civil pedimos a los senadores y senadoras que rechacen la Ley Bases.<\/strong><\/p>\n

El proyecto que trata el Senado plantea que los beneficios otorgados a las empresas adheridas al RIGI tengan prioridad por sobre el respeto a los derechos humanos y la protecci\u00f3n del ambiente. Los proyectos de inversi\u00f3n no podr\u00e1n ser afectados por regulaciones sobre el suministro, transporte y procesamiento de insumos que puedan afectar el proceso productivo. De esta manera, en caso de escasez de agua o de energ\u00eda, por ejemplo, la prioridad en el acceso a ambos recursos la tendr\u00e1n las empresas beneficiadas por el RIGI, por sobre las personas. Tampoco habr\u00e1 controles para las obras de infraestructura que realicen las empresas. Ninguna ley podr\u00e1 afectar esas obras, incluso si se trata de leyes de protecci\u00f3n de derechos o del ambiente. Adem\u00e1s, si bien el dictamen incorpor\u00f3 requisitos vinculados a la protecci\u00f3n del empleo y a la industria local, no incluy\u00f3 ning\u00fan requisito referido a la evaluaci\u00f3n de impacto y a la protecci\u00f3n ambiental por parte de las empresas que se ampararon en RIGI.<\/p>\n

El RIGI tambi\u00e9n contradice el derecho de las comunidades ind\u00edgenas a tener informaci\u00f3n adecuada y suficiente y a participar en los procesos de toma de decisiones que van a afectar a los territorios donde viven desde siempre. Los cort\u00edsimos plazos que se establecen para la aprobaci\u00f3n de proyectos -30 d\u00edas con posibilidad de ampliarlo 15 d\u00edas m\u00e1s- son incompatibles con los procedimientos necesarios para garantizar este derecho.<\/p>\n

Por \u00faltimo, el proyecto establece que cualquier ley, provincial o nacional, que \u201climite, restrinja, vulnere, obstaculice o desvirt\u00fae\u201d el RIGI ser\u00e1 declarada \u201cnula de nulidad absoluta e insanable y la Justicia federal deber\u00e1, en forma inmediata, impedir su aplicaci\u00f3n\u201d. Esto supone un avasallamiento no s\u00f3lo a las autonom\u00edas provinciales sino tambi\u00e9n a uno de los principios m\u00e1s b\u00e1sicos de la democracia: la posibilidad de definir mediante mecanismos de deliberaci\u00f3n democr\u00e1tica las leyes bajo las cuales nos regimos como comunidad<\/p>\n

Por todas estas razones, le solicitamos a senadores y senadoras:<\/p>\n

que defiendan sus territorios, sus recursos naturales y el derecho al ambiente sano de todos y todas los habitantes de este pa\u00eds,
\nque protejan los derechos de las comunidades campesinas e ind\u00edgenas que viven en sus territorios desde hace generaciones,
\nque defiendan el derecho de todos y todas a definir nuestras leyes, sin quedar sujetos a las condiciones establecidas por el RIGI por los pr\u00f3ximos 30 a\u00f1os,
\nque respeten el principio de equidad intergeneracional y eviten comprometer a las generaciones futuras con arquitecturas legales sin mirada social ni ambiental.<\/p>\n
